Santa Monica Airport - Heading Toward a Hearing to Dismiss on Feb 10



The legal battle over the Santa Monica Airport is just starting to really heat up. The FAA filed a motion to dismiss the airport lawsuit saying that in the 1948 instrument of transfer, the city was bound by the following condition: “That no property transferred by this instrument shall be used, leased, sold, salvaged, or disposed of by [the City] for other than airport purposes without the written consent of the Civil Aeronautics Administrator [predecessor of the FAA].”

The city of Santa Monica has fired back saying it is unconstitutional for the FAA to require the city to use the land as an airport forever. It will be interesting what happens on Feb 10 when the hearing on whether or not to dismiss takes place.
